          "The Northport Power Station has driven a long-running legal dispute between the Long Island Power Authority (LIPA) and the Town of Huntington over its tax assessment. In June 1997, LILCO and LIPA signed a \"Power Supply Agreement\" (PSA) under which LILCO agreed to sell LIPA the output of its generating plants, including facilities in the Town of Huntington; under PSA section 21.16, LILCO's successor could challenge property tax assessments only under specified conditions, and an August 6, 1997 letter from LIPA advised then-Town Supervisor Frank P. Petrone that pending certiorari proceedings against the Town would be affected.[26] The Town later sued LIPA and LILCO for breach of contract, claiming it was an intended third-party beneficiary of section 21.16; the defendants moved to dismiss, and in Town of Huntington v. Long Island Power Authority, 130 A.D.3d 1013 (2d Dept. 2015), the Appellate Division, Second Department, affirmed denial of that motion, holding that triable issues of fact existed as to the Town's third-party beneficiary status.[26]",
          "Separately, LIPA itself brought tax certiorari proceedings under Real Property Tax Law Article 7 challenging the Northport Power Station's assessments for the 2010/2011 through 2014/2015 tax years. The Assessor, Board of Assessment Review and Town of Huntington moved to dismiss those proceedings for lack of standing, and the Supreme Court, Suffolk County, granted dismissal in 2015. In Matter of Long Island Power Authority v.
