What Happened
Diana Kutateladze, 36, of Oceanside, was driving westbound on the Southern State Parkway in Malverne just after 10 p.m. last night when she sideswiped another vehicle in the left lane while allegedly driving drunk and speeding, according to New York State Police. Troopers said Kutateladze lost control of her car after the initial collision, crossed the center median, and continued driving westbound in the eastbound lanes.
The wrong-way driver struck multiple vehicles while traveling in the opposite direction of traffic, investigators said. Kutateladze collided head-on with a black Toyota Highlander, killing both occupants instantly. The victims were identified as Donald Maxwell, 82, and Liscent Maxwell, 88, who died at the scene of the crash.
The multi-vehicle collision involved a total of six cars and 10 people west of exit 17S on the Southern State Parkway, according to state police. Kutateladze had a passenger in her vehicle at the time of the initial sideswipe collision that triggered the deadly chain of events.
Several other drivers and passengers involved in the crash were transported to area hospitals for treatment, troopers said. One person remains in critical condition, while the remaining injured parties sustained non-life-threatening injuries, according to police reports.
State police investigators determined that both speed and impairment were contributing factors in the fatal crash. The collision forced authorities to completely shut down the Southern State Parkway between exits 15 and 17 for seven hours overnight as emergency crews worked to clear the wreckage and conduct their investigation.
Kutateladze was arrested at the scene and faces multiple serious charges in connection with the deadly crash. She has been charged with aggravated vehicular homicide, two counts of vehicular manslaughter, second degree assault, driving while intoxicated, and reckless driving, according to state police.
Location & Road Context
The crash occurred on the Southern State Parkway in Malverne, one of Long Island’s major east-west arteries that carries thousands of commuters daily between Nassau and Suffolk counties. The collision happened west of exit 17S, which serves as an access point to Hempstead Turnpike and the surrounding Malverne area.
This section of roadway has seen significant incident activity, with 123 recorded incidents in traffic databases. Recent events on the Southern State Parkway include ongoing overnight roadwork and crack sealing operations, as well as previous serious crashes that have raised concerns about safety conditions along this heavily traveled route.
Investigation & Legal Proceedings
The comprehensive investigation into the multi-vehicle fatal crash involved extensive scene reconstruction and evidence collection during the seven-hour parkway closure. State police investigators worked through the night to document the collision patterns and gather physical evidence from all six vehicles involved in the chain-reaction crash.
Kutateladze now faces some of the most serious vehicular crime charges under New York State law, including aggravated vehicular homicide, which carries potential penalties of up to 25 years in prison. The multiple charges reflect both the severity of the crash and the alleged impaired driving that investigators say caused the fatal collision.
Broader Impact
Aggravated vehicular homicide charges in New York are reserved for the most serious impaired driving cases involving fatalities, typically when defendants have elevated blood alcohol levels or multiple aggravating factors such as excessive speed. The charge carries significantly harsher penalties than standard vehicular manslaughter, reflecting the state’s commitment to prosecuting deadly drunk driving cases to the fullest extent of the law.
