Franklin Square is an unincorporated hamlet in the Town of Hempstead, whose founding deed the Town's own archives date to December 13, 1643, negotiated between English emissaries Robert Fordham and John Carman and representatives of local Native tribes, with a Dutch patent confirming the settlers' title following in November 1644.[1] A convention held in Hempstead in February 1665 adopted the Duke's Laws, the first code of law and local government for the English colony of New York.[1] The Town of Hempstead today comprises 34 unincorporated areas, including Franklin Square, alongside 22 incorporated villages; Franklin Square has never incorporated as a village and has no separate municipal government.[1]
Law and legal history
As an unincorporated hamlet, Franklin Square is governed by the Town of Hempstead's own prior-written-notice law rather than a village code. Town of Hempstead Code Chapter 6, "Liability of Town," adopted by Local Law No. 36-1993 and effective July 6, 1993, bars a civil action against the Town for damages from a defective highway, bridge or culvert -- or a defective sidewalk, walkway, footpath, bicycle pathway or traffic sign, or snow or ice on one -- "unless written notice... was actually served upon the Town Clerk or Town Commissioner of Highways" and the Town then failed to act within a reasonable time.[6] The same chapter states the Town Board's intent to supersede New York Town Law § 65-a and General Municipal Law § 50-e(4) to require this prior written notice as a condition of suit.[6]
